The Agreement attached below between the Kouga Municipality and the St Francis Bay Beach Trust was approved by the full Council of the Kouga Municipality on 18 December, 2006. This followed the final approval of the Agreement at the Council Meeting held on 13 December, 2006. This approval follows the Council Resolution of 7 September, 2006 which states:

• That the Council supports the community initiative via the St Francis Bay Beach Trust to resolve the beach erosion via an artificial reef/s subject to:
  
  a. Submission of appropriate agreement/s for consideration by the Council in due course.
  b. Compliance with any legislation that may apply to the project.
  c. Undertake the appropriate Public Participation Process as required by legislation.
   

As a result of the above we then requested our attorney's Rushmere Noach to draft the following Agreement for approval by Council. In addition, we have already held the public participation process in St Francis Bay on 19 December, 2006. This covered both the EIA as well as the Special Beach Levy.
